Most people have heard of libel and slander and defamation. The best way to think of business disparagement is to imagine a business, or a company, being libeled or slandered. If someone makes malicious, false and disparaging statements about your business, and it damages your business, your business may be able to sue for disparagement. The most famous example is when a group of Texas cattle feeders sue Oprah Winfrey after she allegedly made disparaging comments on her show about the safety of the beef industry.
